Case Note & Summary
The appellant, Kammasandra Milk Producers Co-operative Society Ltd., filed a writ appeal against the judgment and order dated 31.01.2012 passed by the Single Judge in W.P.No.7212/2007. The respondent No.1, Sri K. Shivanna, was working as Secretary in the Co-operative Society. In 1989, he was dismissed from service. He challenged the dismissal before the Assistant Registrar of Co-operative Societies, who set aside the dismissal and ordered reinstatement. The Society challenged that order before the Karnataka Co-operative Appellate Tribunal, which upheld the reinstatement. The respondent No.1 was reinstated on 26.10.1993. Thereafter, he filed a writ petition seeking back wages from the date of dismissal till reinstatement. The Single Judge dismissed the writ petition but directed the Society to pay arrears of salary from 14.5.1990 till the date of reinstatement on 26.10.1993 and granted time to the respondent No.1 to challenge the dismissal order, directing that delay be ignored. The Society appealed against this direction. The Division Bench held that the direction to pay back wages and ignore delay was not justified as the dismissal order was not challenged for many years. The appeal was allowed, and the impugned directions were set aside.
