The Revenue filed revision petitions under Section 23 of the Karnataka Sales Tax Act, 1957, challenging a common order of the Karnataka Appellate Tribunal (KAT) in STA Nos.3500 and 3501/2013 for the assessment years 2006-2007 and 2007-2008. The respondent, M/s Shree Renuka Sugars Limited, a company registered under the Companies Act, 1956, was engaged in the manufacture and sale of sugar. The Assessing Authority had originally assessed the respondent to tax on 25.04.2009. Subsequently, on 23.01.2010, the Assessing Authority passed a rectification order under Section 25-A of the Act, on the ground that sugarcane purchased from crushing units at Haveri, Havalaga, Guralatti, and Alanda was not eligible for the benefit of treating the tax on purchase of sugarcane as a loan for a period of ten years. Pursuant to this rectification order, additional tax was demanded and paid by the assessee. The respondent was then issued notices for payment of interest on the delayed payment of taxes under Section 13-B of the Act. The respondent challenged the rectification order and the interest demand before the Karnataka Appellate Tribunal, which allowed the appeals, holding that the rectification order was beyond the scope of Section 25-A and that the interest demand was unsustainable. The Revenue, aggrieved by the Tribunal's order, filed the present revision petitions. The High Court examined the scope of Section 25-A of the Act, which permits rectification of errors apparent on the face of the record. The court found that the rectification order sought to reopen the assessment on a new ground, namely, the eligibility of sugarcane purchases from certain units for the loan benefit, which was not an error apparent on the record but a matter that required a review of the merits.
