The appellant, Dattatreya, a conductor with the North East Karnataka Road Transport Corporation, was dismissed from service on 28.01.2002 for failing to issue tickets to 15 passengers. He raised a dispute before the Labour Court, which dismissed the reference holding the charges proved. However, in a subsequent writ petition, the learned Single Judge set aside the dismissal and directed reinstatement with continuity of service but without backwages. The Corporation reinstated the appellant but denied him consequential benefits such as restoration of his pay scale to Rs.13,440/- from October 2016 and annual increments for 2014, 2015, and 2016. The appellant filed a writ petition seeking these benefits, which was dismissed by the learned Single Judge. Aggrieved, he filed the present writ appeal. The Division Bench held that once continuity of service is granted, the employee is entitled to all consequential benefits including pay fixation and annual increments, unless specifically excluded. The court allowed the appeal, set aside the order of the learned Single Judge, and directed the respondents to extend the benefit of continuity of service with all consequential benefits, including restoration of pay scale and release of annual increments for 2014, 2015, and 2016.
