The appellant, Mahammad Shafi, a coolie worker aged 22, sustained injuries in a motor vehicle accident on 24.02.2008 when a Tata Sumo hit him while he was walking on the left side of P.B. Road. He suffered a fracture of the femur and other injuries. The Tribunal awarded total compensation of Rs. 1,05,000/- with interest at 6% per annum. Dissatisfied, the claimant appealed for enhancement under Section 173(1) of the Motor Vehicles Act, 1988. The High Court found that the Tribunal had assessed the claimant's notional income at Rs. 3,000/- per month, which was too low. Considering the accident occurred in 2008, the court applied the notional income of Rs. 4,500/- per month as per the Karnataka State Legal Services Authority chart. The court also applied 40% addition towards future prospects as per Pranay Sethi, since the claimant was 22 years old and self-employed. The functional disability was assessed at 10% to the whole body. The court recalculated the loss of future income using the multiplier of 18 (as per Sarla Verma) and awarded Rs. 1,36,080/- under that head. Additionally, the court enhanced compensation for medical expenses (Rs. 25,000/-), pain and suffering (Rs. 30,000/-), loss of amenities (Rs. 15,000/-), and conveyance, nutrition, and attendant charges (Rs. 15,000/-). The total enhanced compensation was fixed at Rs. 2,21,080/- with interest at 6% per annum from the date of petition till realization. The appeal was allowed in part.
