The plaintiff, a construction company, filed a commercial suit against a partnership firm (first defendant) and its partners (defendants 2 to 6) for recovery of Rs.4,83,72,278/- with interest. The plaintiff had subscribed to a chit fund conducted by the defendants, paying Rs.20 lakhs per month for 20 months from May 2013, with a maturity value of Rs.4 crores. The second defendant assured the plaintiff that the chit was registered under the Chit Funds Act, 1982 and the Tamil Nadu Chit Fund Rules, and promised prompt settlement. Despite regular remittances, the defendants persuaded the plaintiff not to participate in bids, promising the full maturity value at the end. After the chit matured in December 2014, the defendants failed to pay, citing defaults by other subscribers. The plaintiff’s inability to recover the funds caused financial difficulties with banks and the Income Tax Department. On 27 June 2015, the defendants acknowledged a liability of Rs.3,48,00,200 in a joint statement. Another acknowledgment on 12 December 2015 indicated a liability of Rs.4,48,53,310, but the plaintiff contended this did not represent the full maturity value. Between March and December 2016, the defendants paid Rs.80 lakhs towards other chits. Repeated assurances and promises of settlement were made, but no further payments materialized. The defendants filed a separate suit (O.S. No.2285 of 2017) before the City Civil Court, Chennai, for injunction and accounts against the plaintiff. The plaintiff issued a legal notice on 19 April 2017; the defendants replied admitting liability but sought time. The present suit was then instituted, seeking recovery of the chit amount with interest, raising issues of maintainability of the defendant’s suit under Section 69 of the Indian Partnership Act, 1932, and questioning the registration and compliance under the Chit Funds Act, 1982. The suit also sought costs.
