Procedural History

On 24.10.2012, Sapna went missing and her father lodged a missing report. On 19.11.2012, her mother lodged a complaint alleging kidnapping and murder, leading to registration of Crime No.95 of 2012 on 20.11.2012. Investigation was taken over by PI Chadansinh Bayas on 17.12.2012. On 21.5.2013, human bones and clothes were discovered in a field. Accused were arrested on 25.5.2013, and various recoveries were made pursuant to their statements. After completion of investigation, charge sheet was filed. The trial court in Sessions Trial No.114 of 2013 convicted the accused and sentenced them on 14.8.2017. The death sentence was referred to the High Court under Section 366 Cr.P.C., and the convicted accused filed Criminal Appeal No.515 of 2017. Both matters were heard together, and judgment was reserved on 19.10.2018 and pronounced on 21.12.2018.
