The appellant, Deepak Ramchandra Chavan, was convicted by the 5th AdHoc Additional Sessions Judge, Greater Mumbai, in Sessions Case No.796 of 2008 for the murder of Jerry Fernandis under Section 302 of the Indian Penal Code and sentenced to rigorous imprisonment for life and a fine of Rs.2000/-. The incident occurred on the intervening night of 10th and 11th September 2008, between 2.30 a.m. and 3.00 a.m., during a Ganesh festival celebration. A quarrel broke out between the appellant and the deceased in a pandol, leading to a scuffle. The appellant slapped the deceased, causing him to fall, then kicked him on the mouth, chest, stomach, and leg, assaulted him with a bamboo stick, and finally hurled a stone on his head. The deceased was taken to Nair Hospital by witnesses including Sagar Chonkar (PW-7) and Vanita Jerry Fernandis (PW-9), but succumbed to injuries at 6.30 a.m. on 11th September 2008. Initially, an offence under Section 307 of the Code of Criminal Procedure was registered, but after the death, it was altered to Section 302. The trial court convicted the appellant. On appeal, the High Court examined the evidence of key witnesses: Sachin Lakhan (PW-1), an eye-witness; Sagar Chonkar (PW-7), who saw the assault and took the deceased to the hospital; Vanita Jerry Fernandis (PW-9), the wife of the deceased; and Dr. Aarti Gupta (PW-12), who conducted the post-mortem and opined that the death was due to head injury. The court found the testimony of PW-1 and PW-7 credible and consistent, and the medical evidence corroborated the homicidal nature of the death. The defence of total denial was rejected. The High Court upheld the conviction and dismissed the appeal.
