Case Note & Summary

The appellant, Umesh Bharat Gaikwad, was convicted by the Additional Sessions Judge, Bhoom, District Osmanabad for the murder of Kashinath Gaikwad under Section 302 IPC and sentenced to life imprisonment. The incident occurred on 25 December 2013 due to a land dispute over a boundary (Bandh) in Gat No. 117 at Samarkundi. The deceased, his son Satish (PW1), and wife Ashrubai (PW2) were present when the accused, including the appellant, came with a JCB machine to create a Bandh. The deceased requested them to stop until the land was measured, leading to a quarrel. Later that evening at 7:00 p.m., the appellant and others attacked the deceased with sticks and a knife, causing fatal injuries. The prosecution examined eyewitnesses PW1 and PW2, who testified to seeing the appellant assault the deceased. Medical evidence (PW5) confirmed the injuries were homicidal. The trial court convicted the appellant, while other accused were acquitted. The appellant appealed, arguing that the evidence was unreliable and that there was no motive. The High Court upheld the conviction, finding the eyewitness testimony credible and corroborated by medical evidence. The court noted that the land dispute provided motive, and the presence of the appellant at the scene was established. The appeal was dismissed.
