The applicant, Shradhanand Anathalaya, a public trust, filed a civil suit for eviction of the non-applicant, Kusum Chauhan, from a servant quarter under Section 16(1)(f) and (g) of the Maharashtra Rent Control Act, 1999. The premises were let out in lieu of her service with the trust. After her services were terminated, the trust sought eviction. The non-applicant challenged the termination before the Labour Court and filed an application in the civil suit to stay proceedings until the labour complaint was decided. The trial court initially rejected the application, but on appeal, the matter was remanded. After remand, the trial court allowed the stay. The trust challenged this order in the High Court. The High Court held that eviction under Section 16(1)(g) (bona fide need) is independent of service termination and can proceed regardless of the labour proceedings.
