The appellant, Maruti s/o Mahadeo Raut, was convicted under Section 302 of the Indian Penal Code, 1860 for the murder of his wife and sentenced to life imprisonment. The prosecution case was that on the night of 20th/21st August 2002, the appellant killed his wife by strangulation and then set her body on fire to destroy evidence. The motive was that the appellant suspected his wife of having illicit relations. The case was based on circumstantial evidence including last seen evidence, recovery of a kerosene can and matchbox, and a false explanation by the appellant. The trial court convicted the appellant. On appeal, the High Court examined the evidence and found that the chain of circumstances was complete and pointed only to the guilt of the appellant. The court noted that the appellant gave a false explanation under Section 313 CrPC that his wife died due to accidental burns, which was not supported by medical evidence. The court upheld the conviction and sentence.
