The petitioner, Laxmi B. Metkari, was a lessee of a commercial premises in Mumbai under a lease deed dated 13 June 1981, renewed until 28 September 2004. After expiry, she continued occupation without renewal. On 20 December 2016, a show-cause notice was issued by the Executive Engineer, Public Works Department, stating she was an unauthorized occupant and the premises were required for government purposes. The Competent Authority under the Bombay Government Premises (Eviction) Act, 1955 passed an eviction order. The petitioner appealed under Section 7 of the Act to the City Civil Court, which dismissed the appeal on 14 September 2017. A review petition was also dismissed on 9 October 2017. The petitioner then filed a writ petition under Article 227 of the Constitution. The High Court held that the lease had expired, the petitioner was an unauthorized occupant, and the government's requirement for the premises was a valid ground for eviction. The court found no error in the orders of the lower authorities and dismissed the petition.
