The appellant, Smt. Raiwantabai w/o Ramdas Sardare, is the widow of Ramdas Sardare, who was employed as a Drainage Kuli (cleaner) with the Nagpur Municipal Corporation. He died in an accident on 11.03.1996 at about 09:30 a.m. during the course of his employment while performing his duty as a sweeper behind Saint Johns High School, Nagpur. At the time of death, he was 67 years old and earning a salary of Rs.2,940/- per month. The appellant filed a claim petition before the Commissioner under the Workmen's Compensation Act and the Labour Court, Nagpur in W.C.A. Case No.43/1997, seeking compensation of Rs.1,28,330/-. The Commissioner, after appreciating evidence, found that the appellant was entitled to Rs.1,88,645/- as per the calculation under the Act. However, in paragraph 18 of the judgment, the Commissioner held that since the appellant had claimed only Rs.1,28,330/-, she would be entitled to that amount only and not more. Consequently, the respondent was directed to pay only Rs.1,28,330/-. The appellant appealed against this order. The sole legal issue was whether the Commissioner was justified in restricting the award to the claimed amount when the legal entitlement was higher. The appellant argued that the reasoning was erroneous. The court agreed, holding that the Commissioner cannot limit the compensation to the amount claimed when the legal entitlement under the Act is higher. The court set aside the impugned order and directed the respondent to pay the appellant the full amount of Rs.1,88,645/- with interest at 12% per annum from the date of the accident until realization, within two months.
