The appellant, Vidarbha Irrigation Development Corporation, challenged the judgment and award dated 31.12.2005 passed by the 3rd Adhoc Additional District Judge, Yavatmal, which enhanced the compensation payable to respondent No.1, Kunal Hansraj Pise, for the acquisition of his plot bearing No.160 in village Dighi for the Bembla Project. The Land Acquisition Officer had awarded Rs.1,76,634, comprising Rs.75 per sq m for open land and Rs.1236 per sq m for 132.30 sq m of construction. Dissatisfied, the claimant sought enhancement under Section 18 of the Land Acquisition Act, claiming Rs.300 per sq m for the house.
