The land in question, plot no. 28 at village Kohli, was acquired for the Bembla Project via notification under Section 4(1) published on 31.7.2003. The Special Land Acquisition Officer (SLAO) awarded compensation at Rs.90/- per sq.m. by award dated 4.4.2005. Dissatisfied, the landowners (respondents 1 and 2) sought enhancement to Rs.1,000/- per sq.m. before the Reference Court. The appellant resisted, contending that the SLAO's award was just and reasonable. The Reference Court enhanced compensation to Rs.753/- per sq.m., relying on the oral evidence of the claimant and an expert witness, Dhananjay Wamanrao Pachghare, who produced a valuation report (Exh.33/1). The appellant argued that there was no reliable evidence to support the enhancement, as the expert report was based on hypothetical assumptions and the sale instances cited were not comparable. The High Court found that the claimants failed to produce any sale instances of similar lands in the same village to establish the market value. The expert valuation was based on a hypothetical building plan without any actual construction or comparable sales. The court held that the burden of proof lay on the claimants to prove the market value, and they had not discharged it. Consequently, the High Court set aside the Reference Court's judgment and restored the SLAO's award of Rs.90/- per sq.m. The appeal was partly allowed.
