She completed her first, second, and third year semesters of Bachelor of Engineering in Electronics and Telecommunication at Respondent No. 4 college, affiliated with the University of Mumbai, under OBC category based on a caste certificate issued to her. However, the Divisional Caste Scrutiny Committee and the Directorate of Higher Technical Education rejected her OBC claim, leading to the impugned letters/orders dated 28th February 2017 and 5th May 2017, and the college communicated the rejection on 9th May 2017. The petitioner challenged these orders. The court noted that the petitioner's caste is recognized as OBC in the Central list for Tamil Nadu, and she had been pursuing her studies under OBC category. The court held that the Government Resolution dated 22nd August 2014, which requires OBC certificates to be from the Maharashtra State list, does not apply to the petitioner as she belongs to a caste in the Central list. The court set aside the impugned orders and directed the respondents to accept the petitioner's caste certificate and continue her admission under OBC category, allowing the petition.
