Meanwhile, the petitioner purchased the suit property from respondent No.2 on 10.02.2011 vide a registered sale deed. The petitioner filed an application under Order 7 Rule 11(d) CPC contending that the suit for specific performance was barred by limitation under Article 54 of the Limitation Act, 1963, as the agreement was of 1973 and the suit was filed in 2012, i.e., after 39 years. The trial court rejected the application. The High Court allowed the revision, holding that the suit was ex facie barred by limitation and the plaint ought to be rejected. The court noted that the agreement did not fix any date for performance, and the suit was filed more than three years after the date of the agreement, which is the maximum period allowed under Article 54.
