Case Note & Summary

The petitioner, Vinay Kumar Sambare, purchased 1 acre of land via a sale deed dated 15.07.2003 from respondent No.9. The Sub Divisional Officer, Ramtek, by order dated 28.02.2005, cancelled the sale deed under Sections 7 and 8 of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947, on the ground that the land was dry crop land with a standard area of 2 acres, and the sale created a fragment. The petitioner's appeal to the Additional Commissioner, Nagpur, was dismissed on 30.03.2009. The petitioner then filed a writ petition in the Bombay High Court, Nagpur Bench. The petitioner contended that the land was actually paddy land, for which the standard area is 1 acre, and thus the sale was valid. However, the court noted that the petitioner did not file any written statement or reply before the authorities, and the sale deed itself described the land as dry crop land. The court held that the burden was on the petitioner to prove the classification, which he failed to do. The court found no error in the orders of the authorities and dismissed the petition. The judgment was delivered by Justice R.K. Deshpande on 27th April 2017.

Nature of Litigation

Writ petition challenging cancellation of sale deed under fragmentation laws.

Remedy Sought

Petitioner sought quashing of orders dated 28.02.2005 and 30.03.2009 cancelling the sale deed.

Filing Reason

The Sub Divisional Officer cancelled the sale deed of 1 acre dry crop land as it violated the standard area of 2 acres under the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act.

Previous Decisions

Sub Divisional Officer cancelled sale deed on 28.02.2005; Additional Commissioner dismissed appeal on 30.03.2009.

Issues

Whether the sale deed of 1 acre of dry crop land is void under Sections 7 and 8 of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947?

Submissions/Arguments

Petitioner argued that the land was paddy land with standard area of 1 acre, so sale was valid. Respondents (State) supported the orders cancelling the sale deed.

Ratio Decidendi

A sale of land that creates a fragment below the standard area is void under Sections 7 and 8 of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947. The burden is on the purchaser to prove the classification of land, and failure to do so results in cancellation.

Judgment Excerpts

This petition challenges the order dated 28.02.2005 passed by the Sub Divisional Officer, cancelling the sale deed dated 15.07.2003... on the ground that it is in respect of dry crop land and the standard area for fragment prescribed is of 2 acres of land. The petition also challenges the order dated 30.03.2009 passed by the Additional Commissioner, Nagpur, rejecting the appeal filed by the petitioner and confirming the order passed by the Sub Divisional Officer. From the orders impugned, it seems that the petitioner had not filed any written statement or reply. The contention in the petition is that... it is a paddy land for which the standard area of 1 acres is applicable... None appears for the parties except the learned Assistant Government Pleader for respondent Nos.1 and 2.

Procedural History

The Sub Divisional Officer, Ramtek, passed an order on 28.02.2005 cancelling the sale deed. The petitioner appealed to the Additional Commissioner, Nagpur, who dismissed the appeal on 30.03.2009. The petitioner then filed a writ petition in the Bombay High Court, Nagpur Bench, which was dismissed on 27.04.2017.
