Case Note & Summary
The petitioner, S.Balasubramaniyan, filed a writ petition before the Madras High Court seeking a direction to the respondents 1 to 4 (Tahsildar, Revenue Divisional Officer, District Revenue Officer, and District Collector) to remove illegal encroachments and constructions made by respondents 5 to 10 on the petitioner's land. The petitioner had made a representation dated 05.01.2026 to the authorities. When the matter was heard, the learned Additional Government Pleader appearing for respondents 1 to 4 submitted that an enquiry had been conducted and patta had already been granted in favour of the petitioner, cancelling the patta that stood in the name of some other person. The Court noted that since patta had already been granted in the name of the petitioner, any person in occupation of the land is to be dealt with by the petitioner by approaching the competent Civil Court of law in the manner known to law. Accordingly, the Court disposed of the writ petition granting liberty to the petitioner to approach the Civil Court. No costs were imposed.
Headnote

The writ petition seeking direction to revenue authorities to remove encroachment is not maintainable. (Paras 1-3)
Issue of Consideration
Whether the High Court can direct revenue authorities to remove encroachment from land where patta has already been granted to the petitioner.
Final Decision
The writ petition was disposed of granting liberty to the petitioner to approach the Civil Court for eviction of persons in occupation. No costs.
Law Points
- Writ jurisdiction not available for private land disputes
