Case Note & Summary

The petitioner, Sakthivel, filed a writ of mandamus before the Madras High Court seeking directions to respondents 1 to 4 (Government of Tamil Nadu, District Collector, Divisional Engineer Highways, and Assistant Divisional Engineer Highways) to restore the water in and out flow channels of Iyyanar Pond, remove an existing rain-water drain and an illegally constructed pipe culvert, and take measures to prevent sewage and drainage water from entering the tank. The petitioner also impleaded Kalaivani as the fifth respondent. The court noted that the Assistant Divisional Engineer, Highways, filed a status report indicating that a joint committee comprising the Executive Engineer, Vellar Basin Division, Divisional Engineer (Highways), and Executive Engineer (RD, DRDA) had been formed. The committee inspected the site on 18.12.2025 and submitted a report on 19.12.2025. The report revealed that the petitioner objected to the reconstruction of a box-shaped bridge by the Highways Department on the link road connecting Pennadam-Virudhachalam road. The committee inspected Iyyanar Pond in S.No.287/2, Saathukudal Keezhppakku Village, and found that the pond was not used for drinking water purposes. It was also found that the Highways Department had already constructed an RCC pipe culvert at 0/2 Km Uchimedu Link Road, which was being used by the public, and the public had requested strengthening of the road. The reconstruction of the RCC box culvert and road strengthening for 1.20 km was part of the Comprehensive Road Infrastructure Development Scheme 2025-2026. The committee noted that closing the culvert would cause water inundation. The court, after considering the report and submissions, found that the petitioner's grievance was not substantiated and that the Highways Department's actions were in public interest. The court dismissed the writ petition, holding that no direction could be issued to stop the public work.

Nature of Litigation

Writ petition under Article 226 of the Constitution of India seeking a writ of mandamus.

Remedy Sought

Petitioner sought direction to respondents 1 to 4 to restore Iyyanar pond's water in and out flow channels, remove existing rain-water drain and illegally constructed pipe culvert, and prevent sewage and drainage water from entering the tank.

Filing Reason

Petitioner alleged that the Highways Department's construction of a rain-water drain and pipe culvert was illegal and caused sewage and drainage to enter Iyyanar Pond.

Issues

Whether the petitioner is entitled to a writ of mandamus directing the respondents to restore the pond channels and remove the culvert. Whether the Highways Department's reconstruction of the culvert and road strengthening is in public interest and lawful.

Submissions/Arguments

Petitioner argued that the construction of rain-water drain and pipe culvert by the Highways Department was illegal and caused sewage and drainage water to enter Iyyanar Pond. Respondents submitted a status report and joint committee findings that the pond was not used for drinking water, the culvert was necessary to prevent inundation, and the works were part of a government scheme for public benefit.

Ratio Decidendi

A writ of mandamus cannot be issued to stop public infrastructure works that are in the interest of the public and where no violation of legal rights is established. The court will not interfere with administrative decisions based on expert committee reports that demonstrate the necessity and legality of the works.

Judgment Excerpts

Writ of Mandamus has been instituted to direct the respondents 1 to 4 to restore Iyyanar ponds water in and out flow channels and to remove the existing rain water drain constructed by the respondents 1 to 4 and illegally constructed pipe culvert which is being reconstructed by the respondents 1 to 4 and to take necessary measures to prevent sewage and drainage water from entering the tank. The Assistant Divisional Engineer, Highways (C&M), Vridhachalam filed status report. Action was taken by the Department to redress the grievance by forming a Committee... During inspection it was found that the Highways department had already constructed a RCC pipe Culvert in 0/2Km Uchimedu Link Road and the same is being used by the public and the public requested to strength the above said road... Re-Construction of RCC box Culvert along with road strengthening for 1.20 km and culverts at 3 locations) was under Comprehensive Road Infrastructure Development Scheme 2025-2026... Closing the above said culvert will cause water innundation...

Procedural History

The petitioner filed WP No. 50241 of 2025 along with WMP No. 56211 of 2025 before the Madras High Court. The court heard the matter and passed the final order on 22-04-2026.
