The petitioner, Shah Rupal Mahendrabhai, filed two Special Criminal Applications under Article 226 of the Constitution of India before the Gujarat High Court seeking relief against orders passed by the learned 15th Additional Chief Judicial Magistrate, Ahmedabad in Criminal Case No.2746 of 2017 and Criminal Case No.2754 of 2017. On 20.02.2026, the trial court convicted the petitioner under Section 138 of the NI Act and ordered issuance of a non-bailable warrant against him. Aggrieved by the issuance of the warrant, the petitioner approached the High Court seeking time to file an appeal against the conviction order and conversion of the non-bailable warrant into a bailable warrant to enable him to appear before the trial court and furnish bail. The High Court, after considering the submissions, allowed the petitions. The court permitted the petitioner to file an appeal against the orders dated 20.02.2026 within a stipulated time and directed that upon filing the appeal, the petitioner be allowed to pay the amount as specified in the trial court's order within the time stipulated therein. Additionally, the court converted the non-bailable warrant issued against the petitioner into a bailable warrant to facilitate his appearance before the trial court for furnishing bail.
