The applicant wife, Punitaben Hetalkumar Mavadiya, filed an application under Section 24 of the Code of Civil Procedure, 1908, seeking transfer of Family Suit No.178 of 2025, filed by her husband Hetalkumar Pravinchandra Mavadiya for divorce, from the Family Court at Jamnagar to the Family Court at Mithapur, Okha. The wife contended that the distance between Jamnagar and Okha is approximately 170 km one way, and she has to care for her minor son and senior citizen parents, making it difficult to travel to Jamnagar. The Court, after hearing both sides, found that the balance of convenience is in favor of the wife. The Court noted that the wife has pending proceedings at Okha and that the husband can conveniently travel to Okha. Accordingly, the Court allowed the application and transferred Family Suit No.178 of 2025 from the Family Court, Jamnagar, to the Family Court, Mithapur, Okha, for disposal in accordance with law.
