Case Note & Summary

The dispute arose from a motor accident involving a motorcycle and a bus owned by the Gujarat State Road Transport Corporation Ltd. The claimant, Dineshbhai Bhikhabhai Chauhan, sustained serious injuries in the accident that occurred on 28.08.2018. The Motor Accident Claims Tribunal (Tribunal) awarded compensation to the claimant, attributing sole negligence to the bus driver. The appellant corporation challenged this decision, arguing that the motorcyclist was also at fault. The claimant filed cross objections, contending that the Tribunal undervalued his income and failed to award adequate compensation for future prospects and non-pecuniary losses. The court heard arguments from both sides, with the appellant's advocate asserting that the bus driver was not solely negligent, while the claimant's advocate highlighted errors in the Tribunal's compensation assessment. Upon reviewing the evidence, including witness testimonies and documents, the court upheld the Tribunal's finding of negligence against the bus driver but modified the compensation awarded. The court reassessed the claimant's income based on minimum wage standards and added a percentage for future prospects, ultimately increasing the total compensation significantly. The appeal was dismissed, and the cross objections were allowed, leading to a directive for the appellant to pay the enhanced compensation within a specified timeframe.
