The appellants, original claimants, filed an appeal under Section 173 of the Motor Vehicles Act, 1988, against the judgment and award dated 19.09.2022 passed by the Motor Accident Claims Tribunal (Auxi.), Ankleshwar, Bharuch, in MACP No. 09 of 2017. The claimants sought enhancement of compensation for the death of Jayprakash Ramashankar, who died in a road accident on 15.01.2017 when a tanker bearing registration No. GJ-12-AZ-9210, driven rashly and negligently, hit his bicycle from behind on National Highway No. 8. The Tribunal had partly allowed the claim petition, awarding compensation based on an assessed income of Rs. 6,000 per month. The appellants challenged the income assessment and the meagre amounts awarded under conventional heads. The High Court, after hearing the appellant's counsel and perusing the record, noted that the challenge was limited to income and consortium. The court held that in the absence of reliable documentary evidence, the income should be assessed under the Minimum Wages Act, 1948, and enhanced the notional income to Rs. 9,000 per month. Applying a multiplier of 18 and deducting 1/4th towards personal expenses, the loss of dependency was recalculated. The court also enhanced the consortium amount to Rs. 40,000 per claimant (five claimants) and increased other conventional heads as per Pranay Sethi. The total compensation was enhanced from Rs. 12,00,000 to Rs. 17,00,000, with interest at 7.5% per annum from the date of petition till realization. The appeal was partly allowed.

Final Decision
The appeal is partly allowed. The judgment and award dated 19.09.2022 passed by the Motor Accident Claims Tribunal (Auxi.), Ankleshwar, Bharuch in MACP No. 09 of 2017 is modified. The total compensation is enhanced from Rs. 12,00,000 to Rs. 17,00,000. The enhanced amount shall carry interest at the rate of 7.5% per annum from the date of petition till realization. The respondents are directed to deposit the enhanced amount within eight weeks.
