Case Note & Summary
The present Civil Revision Application was filed by the defendants (applicants) challenging the order dated 26/02/2026 passed by the 7th Additional Senior Civil Judge, Gandhinagar, below Exh.27 in Regular Civil Suit No.2 of 2021. The trial court had rejected the defendants' application under Order VII Rule 11 of the Code of Civil Procedure, 1908 (CPC) seeking rejection of the plaint. The plaintiffs (respondents) had filed the suit seeking declaration of title and permanent injunction in respect of land bearing Survey No.1953 (Old Block/Survey No.977), Khata No.635, admeasuring 7790 sq. meters situated in Mauje Uvarsad village, Gandhinagar. The plaintiffs claimed to be heirs and legal representatives of deceased Govindbhai Manilal Valand, who allegedly had title and possession over the suit land. The plaintiffs further alleged that the suit land was of restricted tenure and proceedings under Section 32(p) of the Tenancy Act were carried out, wherein one Chhotabhai Naranbhai was declared as tenant and Govindbhai was declared as owner. The defendants contended that the suit was barred by limitation and res judicata. The trial court rejected the application, holding that the plaint disclosed a cause of action and the issues of limitation and res judicata were mixed questions of law and fact requiring trial. The High Court, after hearing both sides, upheld the trial court's order. The court observed that under Order VII Rule 11 CPC, only the plaint averments are to be considered, and the defence cannot be looked into. The court found that the plaint alleged continuous possession and a cause of action within limitation, and the plea of res judicata required evidence. Therefore, the revision application was dismissed, and the trial court was directed to proceed with the suit expeditiously.
Headnote
A) Civil Procedure Code - Order VII Rule 11 - Rejection of Plaint - Limitation - The court held that the question of limitation is a mixed question of law and fact and cannot be decided at the stage of Order VII Rule 11 unless the plaint is ex-facie barred. The plaint alleged continuous possession and cause of action within limitation, thus rejection was not warranted. (Paras 5-7) B) Civil Procedure Code - Order VII Rule 11 - Res Judicata - The court held that the plea of res judicata requires examination of evidence and cannot be decided solely on plaint averments. The plaint did not disclose any previous adjudication on the same subject matter. (Paras 8-9) C) Tenancy Act - Section 32(p) - Title and Possession - The court noted that the plaintiffs claimed title through inheritance and tenancy proceedings, which raised triable issues. The plaint disclosed a cause of action and could not be rejected summarily. (Paras 2-4)
