Case Note & Summary
The appellant, a retired Judge of the Karnataka High Court, was appointed as Chairman of the Karnataka State Administrative Tribunal by an order dated 15th December 2015. The appointment order specified a fixed salary of Rs.80,000/- and stated that conditions of service would be governed by the Administrative Tribunals Act, 1985. The appellant accepted the appointment. Subsequently, a dispute arose regarding his entitlement to pensionary benefits. The appellant filed a writ petition seeking such benefits, which was dismissed by a learned Single Judge. The present writ appeal was filed against that dismissal. The Division Bench of the High Court considered the provisions of the Administrative Tribunals Act, 1985, particularly Sections 8(7), 9(8), and 17, and the Karnataka State Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman and Members) Rules, 1998. The court noted that Section 8(7) of the Act provides that the Chairman and Members shall be entitled to such salaries and allowances and other conditions of service as may be prescribed. Section 17 empowers the State Government to make rules to carry out the provisions of the Act. The relevant rules, specifically Rule 10 of the 1998 Rules, provide for pensionary benefits. The court held that the fixed salary mentioned in the appointment order did not exclude the appellant's entitlement to pensionary benefits, as the Act and Rules clearly provide for such benefits. The court allowed the appeal, set aside the order of the learned Single Judge, and directed the respondents to grant pensionary benefits to the appellant in accordance with the rules.
Headnote
A) Service Law - Pensionary Benefits - Chairman of State Administrative Tribunal - Sections 8(7), 9(8), 17 of Administrative Tribunals Act, 1985 - The appellant, a retired High Court Judge, was appointed as Chairman of the Karnataka State Administrative Tribunal.
