Nature of Litigation

Appeal against judgments and awards passed by Motor Accident Claims Tribunals in various claim petitions seeking compensation for injuries/fatalities in motor vehicle accidents.

Remedy Sought

The appellants (insurance companies and claimants) sought setting aside or enhancement of the compensation awards passed by the Tribunals.

Filing Reason

The awards were challenged on grounds that the compensation granted was excessive or inadequate, or that the liability was wrongly fixed.

Previous Decisions

The Motor Accident Claims Tribunals had partly allowed the claim petitions and awarded compensation with interest at 6% per annum.

Procedural History

The claims were filed before various Motor Accident Claims Tribunals under the Motor Vehicles Act, 1988. The Tribunals partly allowed the claims and awarded compensation. Aggrieved by the awards, the insurance companies and some claimants filed the present appeals under Section 173(1) of the Motor Vehicles Act before the High Court of Karnataka. The High Court heard the appeals together and passed this common judgment.
