The petitioner, K.P. Narasimhaswamy, a government school teacher, was arrested on 30 January 2020 in connection with Crime No.12/2020 registered at Rampura Police Station, Chitradurga, for offences under Sections 354 and 376 of the Indian Penal Code and Sections 4, 6, 8, 10 and 12 of the Protection of Children from Sexual Offences Act, 2012. The complaint was lodged on 29 January 2020. The petitioner had previously filed a bail application before the Special 2nd Additional District and Sessions Judge, Chitradurga, in Spl.C.(POCSO) No.28/2020, which was dismissed on 10 June 2020. He then approached the High Court under Section 439 of the Code of Criminal Procedure, 1973. The High Court noted that the charge sheet had already been filed and that the petitioner was in judicial custody since 30 January 2020. The court observed that custodial interrogation of the petitioner was not required as the investigation was complete. Considering the nature of the allegations and the stage of the case, the court found that further detention was not necessary. The court granted bail subject to conditions, including that the petitioner shall not tamper with prosecution evidence or influence witnesses, and shall appear before the trial court as required. The judgment was delivered by Justice N.K. Sudhindrarao on 3 July 2020 via video conference.
