The petitioner, Bhuvaneshwar S/o Laxman Masamatti, was working as a Sub-Registrar at Jamakhandi. He was arrayed as accused No.6 in Crime No.24/2020 registered at Jamakhandi Town Police Station for offences punishable under Sections 420, 465, 468, 471 of the Indian Penal Code, 1860 (IPC). The case was based on a complaint by one Chidanand Ajjappa Mali dated 25.02.2020. The complaint alleged that in a compromise decree passed by a civil court in respect of land bearing Survey No.33/3 measuring 10 guntas and Sy.No.33/12 measuring 10 guntas, the accused persons including the petitioner had forged documents and cheated the complainant. The petitioner approached the High Court of Karnataka under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking quashing of the FIR and all proceedings against him. The court examined the allegations in the FIR and found that there were no specific allegations against the petitioner regarding his involvement in the alleged forgery or cheating. The only role attributed to him was that he was the Sub-Registrar who registered the sale deed based on the compromise decree. The court held that mere registration of a document without any allegation of knowledge or intent to commit fraud does not attract criminal liability. The court observed that the petitioner performed his official duty as a registering authority and there was no material to show that he had any mens rea or participated in the alleged conspiracy. Consequently, the court allowed the petition and quashed the FIR and all proceedings against the petitioner.
