Case Note & Summary

The appeals arise out of a motor vehicle accident that occurred on 22.12.2012 involving a lorry bearing registration No.KA-07/AA-1234. The claimants, being the legal representatives of the deceased and the injured, filed claim petitions before the Motor Accidents Claims Tribunal, Kolar. The Tribunal partly allowed the petitions, awarding compensation of Rs. 5,00,000 and Rs. 1,00,000 respectively. Aggrieved by the inadequacy of the compensation, the appellants filed these appeals under Section 173(1) of the Motor Vehicles Act, 1988 seeking enhancement. The High Court, after hearing the parties, enhanced the compensation by applying the correct multiplier and adding future prospects. The court held that the Tribunal had erred in not considering the future prospects and in applying a lower multiplier. The court awarded enhanced compensation with interest at 6% per annum from the date of petition till realization.
