Case Note & Summary

These cross-appeals arose from the Judgment and Award dated 19.01.2018 in MVC No. 758/2015 passed by the Motor Accidents Claims Tribunal, Mysuru. The Tribunal awarded compensation of Rs.17,72,000/- with interest at 7% p.a. to the legal representatives of the deceased, M.K. Harish, who died in a road accident on 02.09.2014. The accident occurred on 18.06.2014 when an autorickshaw carrying two persons and cattle turned turtle due to rash and negligent driving. The deceased was a 29-year-old mason allegedly earning Rs.20,000/- per month. The Insurance Company, Shriram GIC Ltd., appealed (MFA No. 5857/2018) contending that the deceased was an unauthorised passenger in a goods vehicle and that the Tribunal ought to have apportioned contributory negligence. The claimants cross-appealed (MFA No. 7564/2018) seeking enhancement on the ground that no amount was awarded towards future prospects. The High Court heard both appeals together on 08.12.2025. The court considered the issues but the available text does not include the reasoning or final decision.

Nature of Litigation

Appeals under Section 173(1) of the Motor Vehicles Act, 1988 against the award of the Motor Accidents Claims Tribunal in a motor accident compensation claim.

Remedy Sought

The Insurance Company sought apportionment of contributory negligence against the deceased for travelling as an unauthorised passenger in a goods vehicle; the claimants sought enhancement of compensation by awarding future prospects.

Filing Reason

The Insurance Company was aggrieved by the Tribunal's failure to apportion liability towards contributory negligence; the claimants were aggrieved by the denial of future prospects.

Previous Decisions

The Motor Accidents Claims Tribunal, Mysuru, in MVC No. 758/2015 by Judgment and Award dated 19.01.2018 awarded Rs.17,72,000/- with interest at 7% p.a. from the date of petition till realization.

Issues

Whether the Motor Accidents Claims Tribunal correctly assessed compensation without apportioning contributory negligence for an unauthorised passenger in a goods vehicle. Whether the claimants are entitled to future prospects while computing loss of dependency.

Submissions/Arguments

Insurance Company: Deceased was traveling as a gratuitous passenger in a goods vehicle; the driver had no valid license; hence contributory negligence should be apportioned against the deceased. Claimants: No amount was awarded towards future prospects; the deceased was the only earning member and aged 29 years.

Judgment Excerpts

On 18.06.2014 at about 5.30 a.m. when two persons were travelling in Autorickshaw with cattle in the vehicle and due to rash and negligent driving of the driver of the Autorickshaw, the Autorickshaw turned turtle and the deceased succumbed to his injuries subsequently on 02.09.2014. It is contended by the Insurance Company that despite the fact that the deceased was travelling in a goods vehicle as an unauthorised passenger, the Tribunal has not apportioned the liability amount towards contributory negligence against the deceased. The claimants have been awarded the compensation in the sum of Rs.17,72,000/- along with interest at the rate of 7% p.a.

Procedural History

The claimants filed MVC No. 758/2015 before the Motor Accidents Claims Tribunal, Mysuru, which by Judgment and Award dated 19.01.2018 awarded Rs.17,72,000/- with interest. Aggrieved, the Insurance Company filed MFA No. 5857/2018, and the claimants filed MFA No. 7564/2018 for enhancement. Both appeals were heard together by the High Court on 08.12.2025.
