The writ petition, filed by Maharashtra Rajya Suraksha Rakshak & General Kamgar Union on behalf of 81 security guards, challenged termination letters dated 11 August 2025 and 25 August 2025 issued by Respondent No. 4, the Chief Security Officer of IIT Bombay. The petitioner sought quashing of those letters and a direction to continue the services of the security guards who had been allotted to IIT Bombay by the Security Guards Board under the Security Guards (Regulation of Employment and Welfare) Act, 1981 and the Private Security Guards (Regulation of Employment and Welfare) Scheme, 2002. IIT Bombay had registered with the Board as a principal employer with effect from 30 March 2016 and had been receiving guards pursuant to its requests. However, IIT issued termination letters effective 10 October 2025, intending to replace the Board allotments with security personnel from the Maharashtra State Security Corporation or private agencies. The Board repeatedly objected, directing IIT not to terminate the services and warning that the action contravened Clause 25(2) of the Scheme and could be punishable under Clause 42. An inspection by the Board revealed that IIT was engaging private security guards through an external contractor. The petitioner invoked the writ jurisdiction of the Bombay High Court under Article 226 of the Constitution. At the hearing, Respondent Nos. 3 and 4 (IIT Bombay) raised preliminary objections contending that the union had no privity of contract and thus lacked standing, that IIT Bombay was not an 'establishment' within the meaning of the 1981 Act as the definition under Section 2(8) of the Bombay Shops and Establishments Act, 1948 applied only to commercial establishments and places of public amusement, not to central academic institutions, and that the doctrine of ejusdem generis excluded IIT from the statutory definition. They further argued that IIT had voluntarily registered and could discontinue using the Board's services, that the security guards remained within the Board's pool and could be redeployed, and that a Division Bench judgment in Maharashtra Suraksha Rakshak Aghadi v. Maharashtra Film, Stage and Culture Development Corporation Ltd. supported their stand. The petitioner and Respondent No. 2 (Board) relied on certain other writ petition orders where similar issues had been decided.
