Case Note & Summary

The appellant, Patel Kantibhai Ladhabhai, filed three first appeals under the Land Acquisition Act, 1894, seeking enhancement of compensation awarded by the Reference Court in LAR Case Nos. 926, 927, and 929 of 2010. The lands were acquired by the State of Gujarat for the Sujlam Suflam Spreading Canal in Village Akodiya, Taluka Bayad, District Arvalli-Modasa. The Section 4 notification was published on 05.11.2004, and the Section 6 notification on 20.12.2004. The Acquisition Officer declared the market value at Rs.5/- per sq. mtr. on 30.05.2005 under Section 11. The Reference Court, by judgment dated 29.09.2016, enhanced the compensation to Rs.80/- per sq. mtr. The appellant claimed Rs.250/- per sq. mtr. The High Court noted that a related appeal, First Appeal No.5639 of 2019, arising from LAR Case No.930 of 2010 (part of the same acquisition), had been decided on 01.12.2025, awarding compensation at Rs.308.25/- per sq. mtr. with additional compensation of Rs.228.25/- per sq. mtr. after deducting prior awards. The appellant argued for parity. The State could not dispute the precedent. The High Court allowed the appeals, setting aside the Reference Court's award and granting compensation at Rs.308.25/- per sq. mtr., with additional compensation of Rs.228.25/- per sq. mtr., along with statutory benefits under Sections 23(1A), 23(2), and 28 of the Act. The judgment was delivered on 27.01.2026 by Justice M.K. Thakker.

Nature of Litigation

First appeals under Section 54 of the Land Acquisition Act, 1894 seeking enhancement of compensation awarded by the Reference Court.

Remedy Sought

Appellant-claimant sought enhancement of compensation from Rs.80/- per sq. mtr. to Rs.250/- per sq. mtr. for acquired land.

Filing Reason

Dissatisfaction with the compensation awarded by the Reference Court in LAR Case Nos. 926, 927, and 929 of 2010.

Previous Decisions

Acquisition Officer awarded Rs.5/- per sq. mtr. on 30.05.2005; Reference Court enhanced to Rs.80/- per sq. mtr. on 29.09.2016.

Issues

Whether the appellant is entitled to enhanced compensation at the rate of Rs.308.25/- per sq. mtr. as awarded in a related appeal (First Appeal No.5639 of 2019) arising from the same acquisition proceedings.

Submissions/Arguments

Appellant argued that in First Appeal No.5639 of 2019, this Court awarded compensation at Rs.308.25/- per sq. mtr. with additional compensation of Rs.228.25/- per sq. mtr., and the same rate should apply to the present appeals as they arise from the same acquisition. State could not dispute the above aspect and submitted that the Court may pass an appropriate order.

Ratio Decidendi

Consistency in compensation for similarly situated claimants in land acquisition cases requires that the same market value determined in a related appeal be applied to other appeals arising from the same acquisition proceedings.

Judgment Excerpts
