The appellant, Patel Kantibhai Ladhabhai, filed three first appeals under the Land Acquisition Act, 1894, seeking enhancement of compensation awarded by the Reference Court in LAR Case Nos. 926, 927, and 929 of 2010. The lands were acquired by the State of Gujarat for the Sujlam Suflam Spreading Canal in Village Akodiya, Taluka Bayad, District Arvalli-Modasa. The appellant argued for parity. The State could not dispute the precedent. The High Court allowed the appeals, setting aside the Reference Court's award and granting compensation at Rs.308.25/- per sq. mtr., with additional compensation of Rs.228.25/- per sq. mtr., along with statutory benefits under Sections 23(1A), 23(2), and 28 of the Act. The appellant is also entitled to statutory benefits under Sections 23(1A), 23(2), and 28 of the Land Acquisition Act, 1894.
