Procedural History
On 26th June 2006, 100 shares of Contrex Pvt. Ltd. were transferred by Ashok Gokal and Kishore Gokal and their respective wives to Ramanlal Gokal and his sons Mukesh and Bharat. Ramanlal died on 22nd March 2007, leaving a will dated 25th January 2005 and a codicil dated 28th June 2006, appointing executors. Ashok Gokal filed Testamentary Petition No. 733 of 2007 for probate, which was granted on 13th December 2007, with the shares listed in the asset schedule. On 12th March 2010, an estate administration report was filed by the executors. Subsequently, Mukesh and Bharat Gokal initiated proceedings to remove Ashok and Kishore as executors; the court removed them, leaving only Hemraj Asher and Prashant Asher as executors. The plaintiffs filed Suit (L) No. 352 of 2015 and took out Notice of Motion (L) No. 1073 of 2015 seeking interim relief. The contesting defendants raised preliminary objections regarding limitation and maintainability, which the court addressed in the present judgment.
