The Full Bench of the Bombay High Court was constituted to resolve a conflict between two Division Bench judgments on the interpretation of Rule 36(2)(a)(iii) of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981, regarding the eligibility of a retired awardee teacher to serve as the third member of an inquiry committee under the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977. The reference arose in a batch of writ petitions where School Tribunals had held that inquiry committees were defectively constituted because the third member chosen was a retired teacher who had received a State or National award, following the ruling in Leelatai Patil v. State of Maharashtra (Writ Petition No.5867 of 2008) which held that the awardee teacher must be in service. However, an earlier Division Bench in Sudha Saikhede v. Yashodabai Shikshan Sanstha (2003 (4) Mh.L.J. 659) had taken the view that there is no bar for a retired awardee teacher to be a member. A Single Judge, noting that the conflict recurs in many cases before School Tribunals and that the decision in Leelatai Patil had not considered Sudha Saikhede, referred the matter to a larger bench. The management institutions challenged the School Tribunal’s orders of reinstatement with back wages, arguing that Rule 36(2)(a)(iii) does not impose an in-service requirement and that the plain language permits any teacher from the panel of awardee teachers, irrespective of retirement. They relied on the definitions in the MEPS Act and Rules, the purpose of the provision to ensure an impartial inquiry, and a government circular allowing retired teachers subject to age limits. The respondents supported the view that the awardee teacher must be in service. The Full Bench reserved judgment on 21 January 2016 and pronounced it on 10 March 2016, clarifying that it would only answer the referred questions and not decide the individual cases on merits, which would be sent back to appropriate Benches.

Submissions/Arguments

Rule 36(2)(a)(iii) of MEPS Rules does not contain any bar against an awardee teacher who has retired; plain language permits any teacher from the panel of awardee teachers. Distinction between sub-clauses (ii) and (iii) of Rule 36(2)(a) shows that no requirement of in-service status exists for the awardee teacher. Awards are conferred for meritorious past service and are retained even after superannuation; detailed information about teaching abilities is sought while in service. The Division Bench in Sudha Saikhede correctly held that there is no bar for a retired awardee teacher; Leelatai Patil erroneously added words to the rule and did not consider Sudha Saikhede. Government circular supports allowing retired teachers as members, subject to age limit of 65 years and not being overburdened. The later judgment in Kranti Junior Adhyapak Mahavidyalaya followed Leelatai Patil without analysis, perpetuating the conflict.
