Case Note & Summary
The petitioner, Sarpanch of Gram Panchayat Amgaon, filed a Public Interest Litigation challenging a notification dated 12.2.2015 issued by the State of Maharashtra under Section 341A of the Maharashtra Municipal Councils, Nagar Panchayats & Industrial Townships Act, 1965. The notification constituted the area within the Amgaon Gram Panchayat as a Nagar Panchayat. The petitioner sought a direction to include the areas of seven surrounding Gram Panchayats (Bangaon, Risama, Kumbhartoli, Padampur, Malhi, Kidangipar, and Birsi) in the Nagar Panchayat, arguing that these villages are part of the same urban agglomeration and that government offices named after Amgaon are situated in those areas. The Court noted that the village Amgaon is a Tahsil headquarters and has various government offices, but many of these offices are actually located within the jurisdiction of other Gram Panchayats. The Court examined the provisions of Section 341A and Section 3(2) of the Act. It held that the State Government has the discretion to decide the area to be included in a Nagar Panchayat and is not obliged to include all surrounding villages. The Court found that the notification was valid and did not suffer from any illegality. The petition was dismissed, and the rule was discharged with no order as to costs.
Headnote
A) Municipal Law - Constitution of Nagar Panchayat - Section 341A of the Maharashtra Municipal Councils, Nagar Panchayats & Industrial Townships Act, 1965 - Discretion of State Government - The petitioner challenged the notification constituting only the Amgaon Gram Panchayat area as a Nagar Panchayat, seeking inclusion of seven surrounding Gram Panchayats. The Court held that the State Government has the discretion to decide the area to be included in the Nagar Panchayat and is not bound to include all surrounding villages merely because they share the name 'Amgaon' or have government offices situated within them. The Court found no illegality in the notification and dismissed the petition. (Paras 2-8)
B) Public Interest Litigation - Maintainability - Challenge to Government Notification - The Court entertained the PIL but found no merit, as the petitioner failed to establish any legal right or public interest that was violated by the impugned notification. (Paras 1-8)

Nature of Litigation
Public Interest Litigation challenging a government notification constituting a Nagar Panchayat.
Remedy Sought
Quashing of notification dated 12.2.2015 and direction to include surrounding Gram Panchayats in the Nagar Panchayat.
Filing Reason
Petitioner aggrieved by notification constituting only Amgaon Gram Panchayat area as Nagar Panchayat, excluding surrounding villages.
Issues
Whether the notification under Section 341A of the Act is valid?
Whether the State Government is obliged to include surrounding Gram Panchayats in the Nagar Panchayat?
Submissions/Arguments
Petitioner argued that the surrounding villages are part of the same urban agglomeration and government offices named after Amgaon are situated in those areas, so they should be included.
Respondents argued that the State Government has discretion under the Act and the notification is valid.
Ratio Decidendi
The State Government has the discretion under Section 341A of the Maharashtra Municipal Councils, Nagar Panchayats & Industrial Townships Act, 1965 to decide the area to be constituted as a Nagar Panchayat. There is no legal obligation to include all surrounding Gram Panchayats merely because they share the same name or have government offices situated within them. The notification is valid and does not suffer from any illegality.
Judgment Excerpts
The petitioner has approached this court being aggrieved by the notification dated 12.2.2015 issued by the respondent no.1 thereby constituting an area within the Amgaon Gram Panchayat area to be a Nagar Panchayat as provided under Section 341(A) of the Maharashtra Municipal Councils, Nagar Panchayats & Industrial Townships Act, 1965.
It is not in dispute that though all these offices are named after Amgaon, for example, Amgaon Tahsil Office or Court of Civil Judge, Junior Division, and Judicial Magistrate, First Class, Amgaon, these are in fact situated within the jurisdiction of the various Gram Panchayats.
We find that the State Government has taken a policy decision to constitute the area of Amgaon Gram Panchayat as a Nagar Panchayat. The State Government has the discretion to decide the area to be included in the Nagar Panchayat. We do not find any illegality in the impugned notification.
Procedural History
The petitioner filed a Public Interest Litigation in the Bombay High Court, Nagpur Bench, challenging the notification dated 12.2.2015. The court issued rule and heard the matter by consent of parties. The petition was dismissed on 10.2.2016.
