The petitioner, Zuberi Zahirullafaq Baquruddin, an employee of the Maharashtra State Road Transport Corporation (MSRTC) as a Sectional Engineer (Electrical), filed a Writ Petition challenging a notice dated 15.01.2015 issued by the respondent No.1 (MSRTC) requiring him to produce a validity certificate of his Scheduled Caste claim within 15 days, failing which his services would be terminated. The petitioner originally belonged to 'Mehtar' caste, recognized as Scheduled Caste, and obtained a certificate to that effect on 27.09.1990. However, he was later informed that Muslim Mehtars are included in the Special Backward Category (SBC) as per Government Resolution. Consequently, he obtained an SBC certificate on 19.06.2014, which was validated by the Scrutiny Committee at Aurangabad. Despite this, the respondent issued the impugned notice. The petitioner sought quashing of the notice and a direction to accept his SBC certificate. The court considered the facts and the Government Resolution, and held that since the petitioner's caste 'Muslim Mehtar' is classified under Special Backward Category, he cannot be treated as Scheduled Caste. The employer cannot insist on a Scheduled Caste certificate when the petitioner already holds a valid SBC certificate. The court allowed the petition, quashed the notice, and directed the respondents to accept the petitioner's SBC validity certificate and not to insist on a Scheduled Caste certificate.
