The case arises from Regular Civil Suit No. 1041 of 2014 pending before the trial court. The applicant (original defendant) filed two applications: one under Order VII Rule 11 of the Code of Civil Procedure, 1908 (CPC) seeking rejection of the plaint, and another under Section 9A of the CPC raising a preliminary issue as to the court's jurisdiction. The trial court passed an order on 13.07.2015 below Exh. 24, deciding the preliminary issue by holding that the court has jurisdiction and that the suit is within limitation. The applicant challenged this order by way of Civil Revision Application No. 77 of 2015 before the Bombay High Court, Nagpur Bench. The High Court partly allowed the revision application, maintaining the dismissal of the application under Order VII Rule 11, but setting aside the order on the preliminary issue under Section 9A. It directed the trial court to frame an appropriate issue under Section 9A CPC on valuation and limitation and decide it after giving the parties an opportunity to lead evidence. The parties agreed to maintain status quo pending the decision on the preliminary issue. No order as to costs.
