The petitioner, Ranjeet Jibhau Shewale, applied for an LPG distributorship at village Dabhadi (Malegaon), District Nashik, under the open (CC) category, pursuant to an advertisement dated 29th October 2012 issued by Hindustan Petroleum Corporation Limited (first respondent). The petitioner obtained a registered lease deed for a showroom from Mr. Sudhakar Baburao Nikam for a period of 15 years from 1st October 2013 to 1st September 2028. However, by communication dated 12th July 2014, the first respondent rejected the petitioner's application on the ground that the lease agreement period was required to be for 15 years from the last date of submission of the application, i.e., 29th October 2013. The petitioner challenged this rejection by way of a writ petition before the Bombay High Court. The court considered the submissions of both parties. The petitioner argued that the rejection was arbitrary as the lease deed covered the required period. The respondent contended that the lease period should be computed from the last date of submission. The court held that the rejection was arbitrary and unreasonable, as the lease deed was for 15 years from 1st October 2013, which covered the entire period from the last date of submission onwards. The court allowed the petition, quashed the communication dated 12th July 2014, and directed the first respondent to consider the petitioner's application afresh in accordance with law, without being influenced by the earlier rejection.
