Case Note & Summary

The writ petition was filed by Navjeevan Shikshan Sanstha and the Head Master of Rani Chitralekha Raje Bhosale School challenging three orders of the School Tribunal, Nagpur: (1) order dated 11-04-2005 condoning delay in filing appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977; (2) order dated 18-07-2005 deciding preliminary issues in favour of the respondent-teacher; and (3) judgment dated 08-08-2005 allowing the appeal and granting reinstatement with continuity and back wages. The respondent No.1, Chandrashekhar Anandraoji Rewatkar, claimed he was appointed as Assistant Teacher on probation on 06-07-1999 by Sadbhawana Bahuuddeshiya Shikshan Sanstha, which later transferred the school to petitioner No.1 society. He continued to serve, but on 23-06-2004 he was not permitted to resume duties, and his services were orally terminated on 21-09-2004. He filed an appeal with a delay condonation application. The School Tribunal condoned the delay, answered preliminary issues in his favour, and allowed the appeal on merits. The petitioners challenged these orders. The High Court, after hearing arguments, dismissed the writ petition, upholding the Tribunal's orders.

Nature of Litigation

Writ petition challenging orders of School Tribunal regarding condonation of delay and reinstatement with back wages.

Remedy Sought

Petitioners sought to quash the School Tribunal's orders condoning delay, deciding preliminary issues, and allowing appeal with reinstatement and back wages.

Filing Reason

Petitioners challenged the School Tribunal's orders as being erroneous and without jurisdiction.

Previous Decisions

School Tribunal condoned delay on 11-04-2005, decided preliminary issues on 18-07-2005, and allowed appeal on 08-08-2005 granting reinstatement with continuity and back wages.

Issues

Whether the School Tribunal correctly condoned the delay in filing the appeal. Whether the School Tribunal was justified in granting reinstatement with continuity and back wages.

Submissions/Arguments

Petitioners argued that the School Tribunal erred in condoning delay and in granting relief. Respondent No.1 supported the Tribunal's orders.

Ratio Decidendi

The School Tribunal's discretion in condoning delay and granting reinstatement with back wages was not shown to be perverse or illegal; hence, no interference warranted.

Judgment Excerpts

This petition takes exception to the order passed by the School Tribunal Nagpur dated 1142005 passed on the application for condonation of delay in filing appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of service) Regulation Act, 1977. The learned Presiding Officer of the School Tribunal by order dated 1142005 condoned the delay in filing the appeal. The appeal was thereafter considered on merits and by judgment dated 882005, the same came to be allowed by granting the relief of reinstatement with continuity in service and back wages in favour of respondent No.1.

Procedural History

Respondent No.1 filed appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 with delay condonation application. School Tribunal condoned delay on 11-04-2005, decided preliminary issues on 18-07-2005, and allowed appeal on 08-08-2005. Petitioners filed writ petition on 2005 challenging these orders. High Court dismissed writ petition on 04-09-2014.
