Case Note & Summary

The petitioner, an elected member of Panchayat Samiti, Kallamb, challenged the order of the Collector, Osmanabad, dated 19th August 2014, which after draw of lots reserved the post of Chairman of Panchayat Samiti, Kallamb for Scheduled Caste (Women) category. The petitioner contended that the post was first reserved for Scheduled Caste category in 1996, again in 2011, and for the third time in 2014, thus violating the rotation principle under Rule 2E of the Maharashtra Zilla Parishads and Panchayat Samitis (Reservation of Offices and Election) Rules, 1962. The court examined the rule and found that the reservation for the same category in consecutive terms was impermissible. The court held that the draw of lots cannot override the statutory requirement of rotation among reserved categories. Consequently, the court quashed the impugned order and directed the respondents to conduct a fresh draw of lots for reservation of the post of Chairman in accordance with the rules, ensuring that the post is not reserved for the same category for a third consecutive term. The petition was allowed with no order as to costs.
