The applicants, Prakash Cotton Mills Pvt. Ltd. and Bharat Barrel And Drum Manufacturing Company Pvt. Ltd., filed two arbitration applications under Section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of a sole arbitrator. The dispute arose from a Deed of Partnership dated 25 March 1997 between the applicants and respondent Nos. 1 and 2, which constituted the partnership firm M/s Kanha & Company (respondent No. 3). The agreement involved joint development of properties pooled by the applicants, with respondents responsible for funding development. Disputes emerged over delays and non-performance by the respondents. The applicants invoked Clause 34 of the deed for termination of the joint development agreement and Clauses 31 and 35 for dissolution of the partnership. The respondents opposed the applications, questioning the entitlement to nominate an arbitrator. Prior to filing, the applicants had obtained interim measures under Section 9. The Court heard both applications together and reserved judgment on 13 August 2014. The judgment was pronounced on 28 August 2014.
