The petitioners, original plaintiffs, filed Regular Civil Suit No.1171 of 2006 seeking declaration that a gift deed dated 10/11/2005 executed by defendant nos.2 and 3 in favor of defendant no.1 was illegal and void, and for partition and permanent injunction. The suit was valued at Rs.200/- for the purpose of court fees and jurisdiction. The trial court decreed the suit in favor of the plaintiffs. The plaintiffs then filed Civil Appeal No.758 of 2008 before the District Court, Pune. The respondents (defendants) filed applications (Exhibits 9 and 14) contending that the appeal was not maintainable before the District Court because the value of the subject matter in the decree exceeded Rs.1,00,000/-, the pecuniary limit of the District Court under Section 6 of the Bombay Civil Courts Act, 1869. The learned District Judge-12, Pune allowed those applications and directed the memo of appeal to be returned for presentation before the appropriate forum. The plaintiffs challenged this order by way of writ petition. The legal issue was whether the forum of appeal is determined by the valuation in the plaint or the valuation in the decree. The court analyzed Section 8 of the Suits Valuation Act, 1887 and Section 6 of the Bombay Civil Courts Act, 1869. The court held that the value of the subject matter for the purpose of appeal is the value as determined by the trial court in the decree, not the original plaint valuation. Since the trial court had determined the value of the suit properties in the decree as exceeding Rs.1,00,000/-, the appeal lay to the High Court, not the District Court. The court dismissed the writ petition, upholding the order of the District Judge.
