The appellant, Smt. Kalawati w/o Jaisingh Suryawanshi, owned Plot No.164 admeasuring 1500 square feet in Nagpur. Adjacent to her plot was an irregular open piece of land admeasuring about 500 square feet belonging to the Nagpur Improvement Trust (NIT). The appellant applied for regularization of this adjacent land as an addition to her plot. The NIT rejected her application. She filed Regular Civil Suit No.7 of 2009 before the Fourth Joint Civil Judge Junior Division, Nagpur, which was decreed in her favor on 25.1.2010, holding that the rejection was wrongful. The NIT appealed to the District Judge-3, Nagpur, in Regular Civil Appeal No.170 of 2010, which was allowed on 27.6.2012, setting aside the trial court's decree. The appellant then filed the present second appeal before the Bombay High Court, Nagpur Bench. The High Court examined the Nagpur Improvement Trust Land Disposal Rules, 1983, particularly Rule 6(3), which allows transfer of land not exceeding 300 square meters that cannot be sold as an individual plot to an adjacent plot holder. The Court noted that the irregular land was about 500 square feet (approximately 46.45 square meters), well within the 300 square meters limit. The Court also referred to Rule 7(2) which provides for a Committee to fix premium for such transfers. The High Court held that the first appellate court had erred in reversing the trial court's decree without properly considering the Rules. The Court allowed the second appeal, set aside the first appellate court's judgment, and restored the trial court's decree. The NIT was directed to consider the appellant's application for regularization in accordance with the Rules and fix the premium accordingly.

The Nagpur Improvement Trust is directed to consider the appellant's application for regularization of the adjacent irregular land in accordance with the Nagpur Improvement Trust Land Disposal Rules, 1983, and fix premium as per rules.
