Case Note & Summary

The petitioner, Alka Keshav Tayade, was elected as Sarpanch of Satara Gram Panchayat from a seat reserved for Scheduled Caste category. She had submitted her nomination as a member from the open category on 4.10.2012 and later submitted her caste certificate for scrutiny on 5.10.2012. However, the last date for filing nominations was 4.10.2012. Respondents 1 to 4 filed a complaint under Section 30(1A) of the Bombay Village Panchayat Act, 1958, alleging that the petitioner failed to produce the acknowledgment of submission of caste certificate before the nomination deadline as required by Section 10(1A). The Additional Commissioner cancelled her election, and the Additional Commissioner upheld that order. The petitioner challenged this in the High Court. The court held that Section 10(1A) is mandatory and requires a candidate contesting from a reserved category to produce the acknowledgment before the last date of filing nominations. Since the petitioner submitted her caste certificate after the deadline, her election was rightly cancelled. The petition was dismissed.

Headnote

A) Election Law - Caste Certificate Validation - Section 10(1A) Bombay Village Panchayat Act, 1958 - Mandatory Compliance - The petitioner, a Scheduled Caste candidate, contested the Sarpanch election from a reserved seat but failed to produce the acknowledgment of submission of her caste certificate for scrutiny before the last date of filing nominations. The court held that compliance with Section 10(1A) is mandatory and the election was rightly cancelled. (Paras 1-10)

B) Election Law - Section 30(1A) Bombay Village Panchayat Act, 1958 - Disqualification - The Additional Commissioner cancelled the petitioner's election under Section 30(1A) for non-compliance with Section 10(1A). The court upheld the order, noting that the petitioner's submission of the caste certificate after the nomination deadline did not cure the defect. (Paras 4-10)

Nature of Litigation

Writ petition challenging cancellation of election to the post of Sarpanch.

Remedy Sought

Petitioner sought quashing of the order dated 9.10.2013 passed by the Additional Commissioner, Aurangabad, cancelling her election as Sarpanch.

Filing Reason

Petitioner's election was cancelled for alleged non-compliance with Section 10(1A) of the Bombay Village Panchayat Act, 1958, which requires a candidate from reserved category to produce acknowledgment of submission of caste certificate for scrutiny before the last date of filing nominations.

Previous Decisions

The Additional Commissioner, Aurangabad, by order dated 9.10.2013, cancelled the petitioner's election as Sarpanch.

Issues

Whether the petitioner complied with Section 10(1A) of the Bombay Village Panchayat Act, 1958 by producing the acknowledgment of submission of caste certificate before the last date of filing nominations. Whether the order of the Additional Commissioner cancelling the petitioner's election is sustainable.

Submissions/Arguments

Petitioner argued that she submitted her caste certificate for scrutiny on 5.10.2012, after the nomination deadline of 4.10.2012, but contended that since she contested from open category for member, Section 10(1A) was not applicable. Respondents argued that the petitioner contested the Sarpanch election from a reserved category and failed to produce the acknowledgment before the nomination deadline, thus violating Section 10(1A).

Ratio Decidendi

Section 10(1A) of the Bombay Village Panchayat Act, 1958 is mandatory and requires a candidate contesting from a reserved category to produce the acknowledgment of submission of caste certificate for scrutiny before the last date of filing nominations. Non-compliance renders the election invalid.

Judgment Excerpts

Being aggrieved by the impugned order dated 9.10.2013 passed by the learned Additional Commissioner, Aurangabad, thereby cancelling the election of the petitioner to the post of Sarpanch of Gram Panchayat, Satara, Taluka and District Aurangabad, the petitioner has preferred this Writ Petition. The petitioner submitted her caste certificate for the scrutiny and validation of the competent scrutiny committee on 5.10.2012. Elections to the post of Sarpanch of Satara Gram Panchayat were held on 19.11.2012. The post of Sarpanch was reserved for Scheduled Caste category. Respondents 1 to 4 filed a complaint against the petitioner on 14.4.2013 before the learned Additional Collector, Aurangabad under Section 30(1A) of the Act of 1958.

Procedural History

The petitioner was elected Sarpanch on 19.11.2012. Respondents 1-4 filed a complaint under Section 30(1A) on 14.4.2013. The Additional Collector cancelled the election. The Additional Commissioner upheld the cancellation on 9.10.2013. The petitioner filed the present writ petition challenging that order.
