The appellant, Smt. Anita Chunnulal Patil, was appointed as an Assistant Teacher by the Upale Rayat Shikshan Sanstha, which runs Haribhau Ghogre High School. The management terminated her services without prior approval of the Education Officer. She challenged the termination before the School Tribunal, which dismissed her appeal. She then filed a writ petition before the Bombay High Court, which was also dismissed by a learned Single Judge. Aggrieved, she filed a Letters Patent Appeal. The Division Bench held that under Section 5 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and Rule 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981, termination of a teacher requires prior approval of the Education Officer.
