The appellants, original plaintiffs, filed Special Civil Suit No.30 of 2007 seeking declaration that a sale deed was illegal, null and void. The respondents (defendants) filed applications under Order VII Rule 11(d) read with Section 151 CPC for rejection of the plaint on the ground that the same plaintiffs had earlier instituted Special Civil Suit Nos.27 of 2006 and 28 of 2006 for the same relief. In those earlier suits, the plaintiffs sought withdrawal with permission to file a fresh suit due to formal defects.
