The State, representing the Competent Authority, contended that conditions 2(ii) and (iii) were not being pressed, and condition 2(i) could be reconsidered upon the society executing an indemnity bond, citing a Single Judge decision in Mazda Construction Company & Ors. v. Sultanabad Darshan CHS Ltd. The court examined the provisions of Sections 10 and 11 of the MOFA Act and held that the Competent Authority's jurisdiction is limited to the statutory inquiry. Conditions 2(i), (ii), and (iii) were extraneous and beyond that jurisdiction, and were therefore quashed. Conditions 2(iv) and (v), dealing with determination of the exact area to be conveyed, were remitted to the Competent Authority for a fresh inquiry, with a direction to consider the claims of other societies in the layout and to complete the process within twelve weeks.
