Case Note & Summary
The petitioner, Namdeo D. Borse, challenged an order dated 03.05.2012 passed by the Scheduled Tribe Certificate Scrutiny Committee, Nashik, which cancelled and confiscated his caste certificate. The petitioner claimed to belong to a Scheduled Tribe and had obtained a caste certificate, which was later invalidated by the Scrutiny Committee. The High Court found that the Scrutiny Committee had failed to consider the Vigilance Cell report dated 01.06.2011, which included a genealogical tree showing the petitioner's blood relation with a validity holder. The Court noted that this was a relevant factor that was completely overlooked by the Committee, especially regarding issue no.2. The Court held that the party must make its case and the Committee must adjudicate based on documents on record. Since the Committee's report overlooked the genealogical tree, it affected the merits of the case. Therefore, in the interests of justice, the Court remanded the matter to the Scrutiny Committee for reconsideration of issue no.2, with liberty to the petitioner to raise other related issues if necessary. The Court directed the Committee to decide the matter in accordance with law at the earliest.

Nature of Litigation
Writ petition challenging cancellation of caste certificate by Scrutiny Committee
Remedy Sought
Petitioner sought quashing of the impugned order dated 03.05.2012 and restoration of his caste certificate
Filing Reason
The Scrutiny Committee cancelled/confiscated the petitioner's caste certificate without considering the Vigilance Cell report and genealogical tree evidence
Previous Decisions
The Scrutiny Committee passed an order on 03.05.2012 cancelling the petitioner's caste certificate
Issues
Whether the Scrutiny Committee erred in cancelling the caste certificate without considering the Vigilance Cell report and genealogical tree evidence
Submissions/Arguments
Petitioner argued that the Scrutiny Committee failed to consider the Vigilance Cell report dated 01.06.2011 which contained a genealogical tree supporting his claim
Respondents argued that the committee had perused the affidavit and found no genealogical tree to prove blood relation
Ratio Decidendi
The Scrutiny Committee must consider all relevant evidence, including Vigilance Cell reports and genealogical trees, before cancelling a caste certificate. Failure to do so vitiates the order and warrants remand.
Judgment Excerpts
The committee, in our view, failed to consider the effect of the Vigilance Cell report dated 01.06.2011, which unless for specific reason, required to be considered by the committee, whereby a genealogical tree of the Applicant's family described his affinity in support of his blood relation.
Therefore, in the interests of justice and in view of above fact we see, a case is made out by the Petitioner to remand the matter with regard to issue no.2.
