Case Note & Summary
The Deputy Director Town Planning of Amravati Municipal Corporation appealed against the judgment of the Reference Court in L.A.C. No.215/2003, which awarded compensation of Rs.5 lakh to the claimants, Mohan and Santosh Jaiswal, for acquisition of their land measuring 1 Hector in Mouja Gambhirpur, Amravati, for a Sewerage Treatment Plant. The land was situated within municipal limits and had potential for residential use, as adjoining land was already used for residential purposes. The Land Acquisition Officer had initially awarded compensation at Rs.7,04,000 per hectare for dry crop land and Rs.14,08,000 per hectare for irrigated land. Dissatisfied, the claimants sought reference, pleading that the compensation was meager given the land's potential and that they restricted their claim to Rs.5 lakh due to financial constraints preventing payment of higher court fees. The Reference Court awarded Rs.5 lakh. The appellant corporation argued that the award was excessive and that the claimants' restricted claim should limit the compensation. The High Court, however, dismissed the appeal, holding that the Reference Court's award was justified considering the land's potential value and that the claimants' financial constraints did not bar a higher award if justified. The court noted that the claimants had specifically pleaded the potential and restricted their claim only due to inability to pay court fees. The appeal was dismissed with no order as to costs.
Headnote
A) Land Acquisition - Compensation - Potential Value - Claimants restricted their claim to Rs.5 lakh due to inability to pay court fee on higher amount - Reference Court awarded Rs.5 lakh considering potential value of land for residential use - Held that the award was justified and not excessive (Paras 1-5).
Issue of Consideration
Whether the Reference Court was justified in awarding compensation of Rs.5 lakh to the claimants despite their restricted claim due to financial constraints, and whether the land's potential for residential use was correctly considered.
Final Decision
The appeal is dismissed. The judgment and order of the Reference Court in L.A.C. No.215/2003 is upheld. No order as to costs.
