Heard learned counsel for the petitioner. It is seen from the record that vide order dated 25.06.2025 the learned State Commission in FA/294/2025 has dismissed the appeal for non-prosecution on account of failure of the appellant to clear the defects as pointed out by the Registry. Learned counsel regrets the delay and states that they have a very good case on merits and seeks the matter be remitted back to the learned State Commission. Heard the learned counsel and perused the records. For the grounds advanced, we consider it appropriate to set aside the order of learned State Commission dated 25.06.2025 and remit the case back to the learned State Commission for consideration as per law, subject to the petitioner depositing Rs. 5,000/- in the Legal Aid Account of learned State Commission, within a period of four weeks. Subject thereto, the order of learned State Commission dated 25.06.2025 is set aside and Appeal No. 294 of 2025 is restored to its original number. It is made clear that in the event of non-deposit of amount as directed above, the SA/595/2025 stands automatically dismissed.
